TERMS OF SERVICE & PRIVACY POLICY

1. OVERVIEW

This agreement ("Agreement") governs your use of Birthday Campaign Club’s services ("Services"). By completing checkout, you agree to these terms and conditions and our data practices outlined below.

2. MONTHLY SUBSCRIPTION & BILLING

Services are billed on a monthly subscription basis. Charges recur every 30 days unless you cancel prior to the next billing cycle. You authorize us to charge your payment method automatically until canceled.

3. NON-REFUNDABLE FIRST MONTH

The first month of service is non-refundable due to setup, labor, and campaign activation costs. By agreeing to these terms, you accept this policy without exception.

4. CANCELLATION POLICY

You may cancel your subscription at any time by contacting us via email. To avoid being charged for the next billing cycle, you must submit your cancellation request before your renewal date. No refunds will be issued for mid-cycle cancellations or unused time.

5. SERVICE DESCRIPTION

Services include birthday campaign strategy, QR code setup, custom sign-up form, email automation, and access to customer list data. We do not guarantee specific results or performance outcomes.

6. INTELLECTUAL PROPERTY

All materials, automation flows, designs, and systems remain the intellectual property of Birthday Campaign Club. You may not reproduce, distribute, or repurpose our content without permission.

7. ACCEPTABLE USE

You agree to use the Services legally and ethically. Misuse, abuse, spamming, or fraudulent activity may result in termination without refund.

8. DATA OWNERSHIP

You retain ownership of customer data collected through our platform. We do not sell or share your customer information. Aggregated, anonymous data may be used for internal performance analysis.

9. LIMITATION OF LIABILITY

We are not liable for indirect, incidental, or consequential damages resulting from the use or inability to use the Services. Our total liability shall not exceed the amount paid in the last 30 days.

10. DISPUTE RESOLUTION

All disputes must be submitted to our support team prior to initiating chargebacks. Legal claims shall be governed by the laws of California, with jurisdiction in Los Angeles County, California.

11. MODIFICATION OF TERMS

We may update these terms at any time. Your continued use constitutes acceptance of any revised terms posted on this page.

12. PRIVACY POLICY – INFORMATION WE COLLECT

We collect contact info (name, email, phone), business info (restaurant name, location), and any details you submit through our forms for onboarding and service delivery.
